Key Ethical and Legal Mandates
Scope of Competency: You MUST practice solely within the bounds of your specific license and documented clinical expertise (e.g., CBT, EMDR, Couples Counseling, Sports Rehab). Never list services for which you lack appropriate training or supervision.
Confidentiality & HIPAA: You are solely responsible for ensuring that all client intake, session notes, and communications are managed within a HIPAA-compliant Electronic Health Record (EHR) system.
Informed Consent: You must provide clear, written Informed Consent to all clients, outlining: fees, cancellation policies, privacy limits (including mandated reporting), and the exact nature of services offered.
Ethical Boundaries: You must adhere to the Ethical Code of your specific licensing board (e.g., ACA, NASW, AAMFT). This includes managing dual relationships, avoiding conflicts of interest, and maintaining professional boundaries.
Good Faith Estimate (GFE): You are legally required under the No Surprises Act to provide private-pay clients with a Good Faith Estimate of the expected costs before services begin.
